What is executive order? Which is used by the American President, which Trump made ‘trump ace’

Taking oath as US President, Donald Trump has issued different executive orders on many things, from immigration, climate to amnesty. Trump’s new orders include major decisions like national emergency on the US-Mexico border, ending citizenship by birth, ending work from home, America’s exit from WHO. Trump shook the world with these orders on his/her very first day as President. Now the question is what is this Executive Order? Why does the US President need to pass it?

What is an executive order?

Executive order is called executive order in Hindi. This is an order issued by the President of the United States, which manages the functioning of the federal government. This is a written order, which does not require the approval of Congress. In a way, this order gives the US President the authority to do any work on his/her own. Only the President of the United States, as head of the US government and commander-in-chief of the country’s armed forces, can issue executive orders.

How long will this order last?

‘Article 2’ of the US Constitution gives this right to the President there. So that he/she can use his/her discretion to determine how to enforce laws or manage the resources and personnel of the executive branch of the Federal Government. Once the President issues an executive order, it remains in effect until it is revoked, revoked, declared illegal, or expires.

Is there any fixed time for executive order?

The President can cancel any executive order at any time. Can amend it. Whether the order has been issued by the current President or by a former President. Typically, a new president reviews executive orders within the first few weeks of his/her or her tenure.

Can executive orders be challenged?

It is not that the executive order cannot be challenged or that it is above legal review. The validity of the executive order and its draft are subject to legal review. If the orders are not supported by law or the Constitution, they can be overturned. The US Congress can also pass a law to repeal the executive order. But the President has the power of veto on such law. However, Congress can also override a veto with a two-thirds majority to override an executive order. But this usually does not happen. It is often argued that it is almost impossible for Congress to repeal an executive order.
