You can say whatever you want but the bench will not come under pressure… When there is a heated argument between the judge and the lawyer in the Supreme Court

New Delhi : There was a heated argument between the bar and the bench in the Supreme Court on Thursday during the hearing of the bail plea of an accused in the Chhattisgarh liquor scam case. A bench of Justices Abhay S Oka and Augustine George Masih questioned the Chhattisgarh government over the lengthy investigation despite three chargesheets being filed in the liquor scam case. On this, senior lawyer Mahesh Jethmalani, appearing for the state, alleged that the bench was prejudiced.

‘You can say whatever you want…’

Responding to the allegation, Justice Oka told Jethmalani that he/she can say whatever he/she wants, but the court will not come under his/her pressure and will decide the case on the basis of evidence. The bench said that now even in PMLA cases, bail is being granted on the basis of delay in trial and long imprisonment. The bench also said that the trial in the case is not going to end in the near future as more than 300 witnesses have to be examined.

We granted you bail…the next day you became a minister! Why did the Supreme Court say this in Balaji case?
The court wondered for how long an accused could be kept in custody. The court was hearing the bail plea of former Chhattisgarh excise officer Arun Pati Tripathi, who has been in custody for the last eight months.

Two months time for investigation

The court asked Jethmalani to produce statements of witnesses showing Tripathi’s involvement in the scam and heard him/her for over an hour and a half. The court, after examining the statements and especially the WhatsApp chats of the accused, decided to give the state two more months to complete the investigation. The court kept the bail plea pending and listed it for February 21.
