How are people with H-1B visas being affected?

Indians are at the forefront in obtaining H-1B visas. After the new order, children of parents living in the US legally or on a temporary visa (such as H1B, H-4, or student visa) after February 19, 2025, will not get automatic citizenship even if they are born in the country. This also includes those families whose mother has a temporary visa and the father is not an American citizen or green card holder. In simple language, if the child of an H-1B visa holder does not have American citizenship, then he/she will have to leave the country after the age of 21 or stay in the country on some other visa.

How will the education of children of H-1B visa holders be affected?

For families living in America on H-1B visa, the new order will not only take away the citizenship of their children, but their future will also be at stake. The biggest impact is going to be on children’s education. Earlier, children born to parents who came to America on work or dependent visas automatically got American citizenship. In this way, as American citizens, they used to get the benefit of state tuition, scholarship and federal aid for studies, but now they will not get the benefit of these facilities. This way they can study, but as a foreign citizen.

H-1B visa holders already have to face the uncertainty of green card, now they will also have to face the problem of children’s education. Without citizenship, children must either leave the United States on their own after turning 21 or apply for a student visa for higher education. Obtaining a student visa, which is already a challenging task, will compound their difficulties. Even if they get a visa, they will be considered foreign students. Because of this, they will neither be able to get scholarship nor the benefit of lower fees.
