US Green Card Rules: Permanent Resident Card, also known as Green Card, is given to live permanently and work in America. Lakhs of people are waiting for green card. There are also a large number of Indians who are waiting to get a green card. In some cases this wait is up to 100 years. Meanwhile, ‘US Citizenship and Immigration Services’ (USCIS) has updated its guidelines for EB-1 category visa (aka Green Card).
Under the EB-1 category, green cards are given to those people who have exceptional ability in science, sports, arts, education, business or their respective fields. There are several other categories of EB visas, including EB-2 and EB-3. Both these categories are employment based. Green cards are given to workers with advanced degrees or specialized knowledge under EB-2 and skilled professional workers under EB-3. However, now Indians are gradually seeking to obtain a Green Card under EB-1.

What is said in the new guidelines?

USCIS guidelines state that EB-1 applications will now focus on the evidence presented to prove extraordinary ability. There are some criteria which must be fulfilled to get a green card. USCIS will now also recognize team awards when applications are submitted to obtain a green card under the EB-1 category. In this way, if someone has been in a team which has received the award, then he/she is also eligible for the green card.

USCIS has also made it clear that if someone has been a member of any reputed group in his/her/her respective field then he/she/she can also be given a green card. According to immigration attorneys, due to the update the eligibility criteria will now become even bigger. Its purpose is to provide greater transparency and help the person applying to present correct evidence. However, the exact impact of the new guidelines is yet to be seen.

There are ten types of criteria for people applying under the EB-1 category, out of which three have to be fulfilled. If someone has been given an award then he/she will also be considered eligible. The updated guidelines state that team awards will be recognized in the ‘International, National Awards and Prizes’ category for EB-1 applicants.
