Justice S Abdul Nazeer: Justice S Abdul Nazeer retired on Wednesday (January 4) after nearly 6 years in the Supreme Court. During his tenure, Justice Nazir has been a member of the bench which decided many cases like triple talaq, Ayodhya, demonetisation.

At his farewell function, the lawyers remembered him as a reticent judge who always smiled and listened to cases. Appreciating him, Vikas Singh, president of the Supreme Court Bar Association, said, “The way Justice Nazeer agreed with the majority verdict in the Ayodhya case shows that the nation is first for him.”

Decision was given on triple talaq

Appointed Supreme Court Justice in February 2017, Justice Nazeer was earlier in the Karnataka High Court for 14 years. Shortly after assuming office in the Supreme Court, he became a member of the Constitution Bench hearing the petitions filed against the system of dissolution of marriage by pronouncing talaq-e-biddat i.e. triple talaq simultaneously. On 22 August 2017, this bench declared instant triple talaq illegal. Three different judgments with identical findings were read out by the five-judge bench. Of these, Justice Nazir remained with the decision given by the then Chief Justice JS Khehar. In that decision, it was said that the government should enact a law to declare triple talaq illegal within 6 months.

Had a big role in the Ayodhya case

Justice Nazir was also a member of the 5-judge bench that heard the Ayodhya case. On 9 November 2019, that bench recognized the claim of the Hindu side on the disputed land. Along with this, the Sunni Waqf Board was also ordered to give separate land away from the disputed site to build a mosque. A bench headed by Justice Nazir had recently upheld the demonetisation done in 2016 by a majority of 4:1.

Justice Nazeer’s Farewell Speech

In his farewell speech, Justice Nazeer said that senior lawyers should play the role of teachers for the junior lawyers working with them. He also expressed concern that the representation of women in the judiciary is still very low. He hoped that more women justices would work in the Supreme Court in the future.
