There is pressure on judges not only from political but also from personal interest groups, CJI Chandrachud spoke openly in the interview.

New Delhi : Chief Justice of India (CJI) DY Chandrachud has said that judges are under pressure not only from political but also from personal interest groups. he/she said this in an interview given to ‘The Times of India’ on Saturday. CJI Chandrachud is retiring on Monday. CJI said that private interest groups create such an environment through TV news channels and social media which creates pressure on the judges to give a particular decision. he/she said that there is a price to be paid for being independent, you will be trolled, you will be attacked.

On the issue of judicial independence, the CJI said that the independence of the judiciary should not be assessed only by looking at those decisions in which the Supreme Court has ruled against the government. “This reflects the state of our politics today,” he/she said. he/she said that polarized views mean that every section of the society judges the independence of the Supreme Court on the basis of whether the decision is in its favor or not.

CJI Chandrachud said, ‘I have always tried to strike a balance.’ The CJI and the Chief Justices of all High Courts have to work closely with governments for administrative tasks. Referring to his/her efforts to improve judicial infrastructure, he/she said the funding for this comes from governments.

he/she said that discussions with governments are necessary to resolve differences between the judiciary and the executive. he/she made his/her point by giving the example of differences between the Supreme Court Collegium and the Central Government on the selection of judges. This issue has been in the headlines many times.

CJI said, ‘I have always been frank with the government’. The CJI said, referring to the occasions when the government had raised objections to the collegium’s decision. “But not all differences can be resolved,” he/she said.

Regarding the government not yet approving the collegium’s decision to appoint advocate Saurabh Kripal as a High Court judge, CJI Chandrachud clearly said that he/she believes that neither the sexual orientation nor The fact that his/her partner is a foreign national cannot be held against him/her while assessing his/her suitability for the job.

The CJI, known for writing clear judgments, said judgments written in outdated or poor English do injustice to justice seekers. Showing that he/she himself was not clinging to old traditions, he/she said he/she was in favor of abolishing the heavy robes worn by lawyers in the hot country.

he/she also questioned the appointment of judges to high positions. he/she asked, ‘Why should judges be placed on high positions?’
