New Delhi : New Delhi: Congress has approached the Supreme Court in protest against the petitions challenging the provisions of the Places of Worship Act. Congress has filed an application in the Supreme Court to protect the Places of Worship Act 1991. Actually, BJP leader and advocate Ashwini Upadhyay has filed an application challenging the Places of Worship Act i.e. Places of Worship Act 1991. An intervention petition has been filed by Congress in this matter.

Congress against the change in the Act

In the application filed by Congress in the Supreme Court, it has been said that this Act (Places of Worship Act 1991) is necessary to protect secularism in the country. The efforts of those challenging this law are full of malicious intent. This is an attempt to weaken the principles of secularism. The petition states that this law is constitutional and emphasizes social importance. This is why he/she wants to intervene.

Reference to communal harmony

Congress has said that any change in this Act can affect the communal harmony and secular fabric of India and can affect the sovereignty and integrity of India and become a threat. This law was made by the Parliament and is an expression of the mandate of the people of India. In the petition, Congress said that it is bound by the principle of secular fabric and its party had played an important role in making the law when it was in majority in the Lok Sabha.

This law was made in 1991 by the PV Narasimha Rao government of Congress. Then the movement for Ram temple was going on in the country and this law was made to protect other religious places of the country. In its application, Congress has said that this law does not violate the fundamental rights provided in the Indian Constitution.

Special bench is hearing

Supreme Court Chief Justice Sanjeev Khanna, Justice Sanjay Kumar and Justice K.V. Vishwanathan’s special bench is hearing the petition filed in this case. Petitioners Ashwini Upadhyay and others argue that the Places of Worship Act is arbitrary and unreasonable and it violates the fundamental rights to practice religion. In March 2021, the Supreme Court had asked the Center to file a reply in this matter.

Other petitions (like Vishwa Bhadra Pujari Purohit Mahasangh and Dr. Subramaniam Swamy etc.) were also filed challenging this law. The government has not yet filed its reply in this matter. In the same matter, recently the Gyanvapi Masjid Management Committee had filed an intervention petition in the Supreme Court in the context of petitions challenging the validity of the Places of Worship Act, 1991.

Why is this act important?

There is a provision under the Places of Worship Act 1991 that the condition of the religious place as it was on August 15, 1947 and the community to which it belonged will remain the same in future.
