Supreme Court: Notice issued to Center-LG on Delhi Service Ordinance, stay on appointment of DERC chairman for a week

A Supreme Court bench headed by Chief Justice of India DY Chandrachud heard today Delhi government’s plea challenging the constitutionality of the ordinance brought in the transfer posting of officers. The Supreme Court has issued notice to the Central Government and the Lieutenant Governor of Delhi during the hearing in this matter. Not only this, the court also stayed the swearing-in of retired Justice Umesh Kumar as the chairman of the Delhi Electricity Regulatory Commission (DERC) till July 11.

A bench of Chief Justice DY Chandrachud and Justice PS Narasimha posted the matter for hearing on July 11 and asked the Center and others to file their replies a day before the hearing.

LG had given instructions to take oath by 10 o’clock

Despite Lieutenant Governor VK Saxena’s direction to Chief Minister Arvind Kejriwal to administer the oath to Delhi Electricity Regulatory Commission (DERC)-designate Justice (Retd) Umesh Kumar by 10 am on Tuesday, he/she was not administered the oath. Delhi’s Power Minister Atishi Kumar was scheduled to be administered the oath of office, but the event was postponed till July 6 due to her sudden “health-related” problems.
