Such atrocities are perpetrated by the very laws made to protect against oppression! May God save every man from such women

New Delhi: If the laws made for justice are misused, then they become the cause of injustice against the purpose. Strict laws were made to ensure that when daughters get married and go to another house, they do not have to face injustice and atrocities there. But it is surprising that women started committing atrocities against those very people for whose protection they were given the weapon of these laws. Whether it is the law of domestic violence against women or the law of protection against cruelty against married women, today both of these have become part of the list of most misused laws. The level of misuse of these laws can be understood from the fact that the Supreme Court of the country had to express concern on this matter.

These two laws are going to be misused the most

The Supreme Court on Wednesday said that Section 498A of the Indian Penal Code (IPC) along with the Domestic Violence Act are among the laws whose provisions are being misused the most. Section 498A of the IPC provides for the harshest punishment for those who commit cruelty on married women. A bench of Supreme Court judges Justice BR Gavai, Justice Prashant Mishra and Justice KV Vishwanathan expressed their anguish while hearing a matrimonial dispute case. While hearing a maintenance case, the Supreme Court bench said in its oral remarks that the laws protecting women from atrocities have become one of the laws being misused with malicious intent.

A case came before the Supreme Court in which a man had to pay alimony of Rs 50 lakh to his/her estranged wife. It is surprising that such a huge amount had to be paid even when the husband and wife had not had physical relations even once and both of them got separated. Justice Gavai mentioned this incident during the hearing and expressed his/her anguish.

Justice Gavai expressed concern

Justice Gavai recalled the case that he/she had seen in Nagpur. he/she said, ‘It is best to get freedom in such cases… I have openly said that domestic violence, 498A is one of the most misused laws. My colleagues will also agree.’ Justice Gavai pointed to the other two judges of the bench. Last month, the Bombay High Court had expressed concern over the misuse of section 498A. The High Court had said that even grandparents and bedridden people are being trapped in these laws.
