Strict laws are needed against hatred speeches … Court rejects BJP leader’s anticipatory bail

New Delhi: The Kerala High Court has said that nowadays the tendency to make statements based on religion and politics is increasing. It should be stopped at the beginning. This is against the basic spirit of our Constitution. The court said that there is no provision of strict punishment in the hafty speech case, in such a situation, the Parliament and the Law Commission have been asked to consider the issue. A copy of this order was directed to send the Chairman of the Law Commission of India. The Kerala High Court on Friday gave the above instructions to a BJP leader, refusing to grant anticipatory bail against a community in the alleged hate speech.

‘The tendency to make statements based on religion and caste is increasing’

The court said that the growing trend of statements based on religion and caste is worrisome. Nowadays the tendency to make statements based on religion and caste is increasing. This is against the basic structure of our constitution. These trends should be stopped at the beginning. Strict laws are needed against hatred speeches. The court said that there is a decrease in the current pineal provision, as the guilty can only avoid paying fine. Sections 196 (1) (A) and 299 of the Indian Code of Justice (BNS) provides for a maximum sentence of three years or fine or both, but the court also has the option to punish only fine. There is no provision of strict punishment for those who commit crimes for the second time. The court asked the Parliament and the Law Commission to consider the issue and directed to send a copy of this order to the Chairman of the Law Commission of India.

BJP leader P.C. George was alleged to have allegedly made objectionable remarks against a community in a live debate of TV. In 2022 too, a case was registered against him/her for making controversial remarks. The court said that earlier while granting him/her bail, the condition was laid that he/she would not make such statements, but he/she violated it. The petitioner’s counsel argued that the tongue was a slipping incident and was impressed by a co-defetter. On this, the court made strict remarks, saying that if a leader can be provoked so easily, he/she is not fit to remain in politics.

‘Politicians should be ideal for society’

BJP leader P.C. George claimed to apologize on Facebook, but the court rejected it and said that the petitioner is a senior politician and had been an MLA for 30 years. The public monitors his/her speeches, statements and behavior. Politicians should be ideal for society. Once when statements that spoil communal harmony are made, the apology sought later is not acceptable. The court made it clear that bail cannot be granted that the accused does not need to interrogate custody. The court refused to grant bail keeping in mind the pre -record of the accused and the seriousness of the allegations.

Court concerns over politics-religion alliance

The court strongly objected to the communal rhetoric in the case related to the Hate Speech. Considering the apology as unacceptable, the leaders were instructed to give a statement responsibly. The case is pending in the Supreme Court regarding the law in the haaftee speech case. The Supreme Court has made many comments on this. The apex court had said that religion and politics are associated with our country, which is why Hate speech is happening. Why can’t the state develop a system to rein in the society, society? Said that the biggest problem is that those who are politicians are using religion.
