So has the CBI’s edge weakened? Not only in Punjab and Bengal, now permission is required for investigation in BJP-ruled MP as well


New Delhi : Questions are being raised about the CBI, one of the major investigation agencies of the country. Is the CBI getting blunt? These questions have arisen because in some states, the Central Bureau of Investigation will have to take written permission from the government for investigation. Without a consent letter, the agency will not be able to go to that state for investigation. Till now, the CBI needed prior permission for investigation only in West Bengal, Tamil Nadu, Punjab, Kerala and Telangana. Opposition parties have been alleging that the BJP government at the Center uses federal agencies to target its opponents. Regarding this, some state governments had made rules for the Central Investigation Agency to take permission for investigation. Now general consent has become necessary in BJP-ruled Madhya Pradesh as well.

MP government’s big decision on CBI investigation

MP is the sixth state where the CBI will have to give information before going for investigation. The Mohan Yadav government of Madhya Pradesh issued a new notification expanding the powers of the CBI within the state. Earlier, prior written permission from the state was required for investigations involving MP government personnel. Now the new notification clarifies that for any other cases, prior general consent and case-by-case permission will have to be taken from the state.

The action of the investigating agency will be affected

CBI will have to take written permission from the Madhya Pradesh administration to investigate any person, government official or institution in the state. CBI will not be able to investigate without the permission of the MP government. The way other states including MP have demanded consent from CBI, it will affect the investigation of the central agency. The biggest question is whether it will be able to conduct its investigation impartially.

How will the CBI investigate?

The question is that if CBI gives the details of any person, organization or case to the state government and administration, will the matter remain confidential? The question is also that whether the CBI will be able to get accurate information about the case for which it is proceeding for investigation after the information. This is because CBI officers who make direct entry in the investigation of any case may get important clues. On the other hand, if action is taken after prior information, then it is natural to raise questions on how successful it will be.
