New Delhi: The Supreme Court will begin hearing today on whether a husband should continue to get legal protection for forced sex with his/her wife if the wife is not a minor. On Wednesday, a bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra said that it will start hearing the petitions on Thursday. This hearing is important because the Central Government opposed criminalizing marital rape. Is. The Center has argued in the Supreme Court that if forceful sexual intercourse by a husband with his/her wife is considered rape, then it will have a very bad impact on marital relations and will also have a serious impact on the sacred institution of marriage.

Senior advocate Karuna Nandi, on behalf of some petitioners, mentioned these petitions before the bench before the end of the day’s proceedings as they had not been mentioned during the day. This matter is related to the petitions which have been filed in the Supreme Court. These petitions demand that marital rape be considered a crime.

What is the argument of the petitioners?

The petitioners say that marriage does not mean that the husband gets the right to forcefully have sex with his/her wife. On the other hand, the Central Government says that bringing such a law will sour the relationship between husband and wife and it can also lead to misuse of the law. Now it remains to be seen what verdict the Supreme Court gives in this matter.

This case will be heard first today

The Chief Justice said, ‘The case of marital rape will be taken up for hearing first, we will start the hearing from tomorrow.’ When Solicitor General Tushar Mehta, appearing for the Centre, sought adjournment, the Chief Justice said, ‘This is a pre-determined matter, let them start it from tomorrow. This matter has been mentioned for urgent hearing several times before.
