SC: Cases are increasing against Hon’ble, UP is at the forefront, Justice’s friend gave information in the report filed in the Supreme Court

The number of cases against MPs and MLAs is continuously increasing. As of November 2022, Uttar Pradesh has the highest number of 1,377 cases registered against the Hon. It is followed by Bihar and Maharashtra with 546 and 482 cases respectively. This information was given by amicus curiae senior advocate Vijay Hansaria and advocate Sneha Kalita in a report filed in the Supreme Court on Monday. The number of pending cases against the Hon’ble was 4,122 in December 2018, which increased to 4,974 in December 2021 and 5,097 in November 2022, the report said.

However, Rajasthan, Uttarakhand, Jammu and Kashmir and Ladakh have not been included in this supplementary report. There data of total pending cases is not available. The Supreme Court is scheduled to take up on Tuesday a PIL filed by Upadhyay for speedy hearing of cases against sitting and former MPs and MLAs.

41 percent cases more than five years old
The report said that 41 per cent of the total pending cases are more than five years old. Despite this, this Court is looking into the Public Interest Litigation filed by Advocate Ashwini Kumar Upadhyay related to the matter. The apex court has passed various interim orders from time to time to expedite the trial against the law makers.

Most pending cases in Odisha
According to the report, the highest number of cases pending for more than five years is in the state of Odisha (71%). It is followed by Bihar (69 per cent) and Uttar Pradesh (52 per cent). This does not include the figures for Meghalaya, as there are four pending cases and all cases are more than five years old.

Money laundering cases on 51 MPs
Earlier, in his 17th status report filed on November 14, Hansaria had said that 51 MPs have been booked by the Enforcement Directorate (ED) for money laundering, while an equal number of MPs are facing cases registered by the CBI. . The report also pointed out that 71 MLAs/MLCs are accused in cases arising out of offenses under the Prevention of Money Laundering Act (PMLA), 2002.
