NEET PG 2025: Supreme Court’s major verdict on NEET PG, Domicile quota ends, judge said- ‘This against the constitution’

In fact, the Supreme Court has given a very important verdict on the rules of reservation in PG Medical Admission. On Wednesday, January 29, the Supreme Court said that admission in medical PG courses on the basis of domicile is wrong. It violates Article 14 (right to equality) of the Indian Constitution.

Why Domicile quota in NEET PG is over?

A three -judge bench hearing the case said, ‘We are all domicile (resident) of India. There is nothing like a separate state domicile. There is only one domicile here. That is, we are all residents of India. We have the right to choose our residence anywhere in the country. It has the right to choose your profession independently. Our constitution also gives us the right to enroll in any educational institution anywhere in India.

Will MBBS have a state quota or not?

Now that the Supreme Court’s decision has come on NEET PG, questions are also being raised on NEET UG. But the apex court has justified domication -based reservation for admission in courses like MBBS, BDS. But in the case of PG, the court says that ‘these are special doctors to make doctors. Specialization and expertise are very important among them. In such a situation, reservation on the basis of residence will be unconstitutional.

PG Medical: What will happen to existing students?

The court has clarified that the latest judgment will not apply to students who have enrolled in PG Medical Courses, studying or have passed. This decision will not affect his/her future.

What is domicile quota in NEET?

For admission in medical, there is only one entrance examination in the country NEET. There is a NEET UG exam for UG courses like MBBS and NEET PG exam for post graduate courses. Then under the All India Kota (AIQ) at the central level, 15 % of the seats are counseled. The state conducts counseling at its level on the rest of the seats. State quota applies in NEET State Counseling. That is, the students living in that state get reservation if they have domicle of that state.
