MLA has no right to become a judge… Gujarat High Court rejects anticipatory bail application of AAP MLA in firing case

Ahmedabad: The troubles of MLA Chaitra Vasava, who has emerged as the vocal face of Aam Aadmi Party (AAP) in Gujarat, have increased. The High Court has rejected the anticipatory bail application of absconding Chaitra Vasava in the case of threatening and firing on forest workers. Vasava had applied in the High Court after not getting bail from Narmada District and Sessions Court. After the High Court rejected his anticipatory bail application, the pressure on him to surrender has increased. The other option for them is to approach the Supreme Court. If sources are to be believed, the MLA will now file an application in the Supreme Court. Chaitra Vasava, elected from Dediapada assembly in Narmada district, is also the leader of the legislature party of Aam Aadmi Party in Gujarat. He was preparing to contest the Lok Sabha elections from Bharuch.

Chaitra Vasava had reached the Gujarat High Court for anticipatory bail, so that the Narmada District Police does not arrest him. Vasava’s application was heard by Justice JC Doshi of Gujarat High Court. Rejecting the anticipatory bail plea after the hearing, he said that the MLA did not have the right to call two forest department officials to his house and run a parallel court to resolve the issue of encroachment on the said land. The High Court, in oral remarks, said that people who had complaints against forest department officials should have approached the court instead of the MLA for resolution of the issue. Justice Doshi said that he had no authority to call the forest officials to his house and he should not have run a parallel court. If anyone has any problem, he should go to court.

The incident took place on the night of October 30 and an FIR was lodged at Dediapada police station on November 2. The MLA’s second wife Varsha Ben Vasava and AAP leaders allege that Chaitra Vasava has been implicated because she spoke against Bharuch MP Mansukh Vasava.
