How to become a lawyer in India?

Before knowing the answers to the above mentioned questions, we have to understand how to become a lawyer in India. Generally, people call a person who looks after legal work a lawyer. Anyone who has obtained a degree by studying LLB (Bachelor of Legislative Law) or LLM (Master of Law) is called a lawyer. However, the most important thing here is that a lawyer can give legal advice to his/her client, but cannot fight the case in the court on his/her behalf. This is the work of a lawyer.

To become a lawyer in India, one has to first study 10+2. After this one has to obtain LLB degree. However, even after getting the degree, you will still be called a lawyer and will not be allowed to fight cases. To fight a case in the court, one has to clear the ‘All India Bar Examination’ (AIBE) of the Bar Council of India, only then one gets a license to practice. As soon as you get the license, you become an advocate from a lawyer.

Who is a barrister?

A person who has obtained a law degree from a university or college in England is called a barrister. Lawyer and barrister are almost similar to some extent. The only difference between the two is that while a lawyer obtains a degree from India, a barrister obtains a law degree from England. Most barristers sit in chambers. They work as legal advisors or academicians for an individual or company. Some banks, corporations and solicitor firms also employ them.

Where does one study to become a barrister?

As you have already been told that barrister education is done in England. In such a situation, the question arises that if someone wants to become a barrister, what will he/she have to do? How can an Indian become a barrister? Let us know what needs to be done to become a barrister.

  • To become a barrister, one must first obtain a Bachelor’s degree in Law.
  • After graduation one has to pass ‘Bar Course Aptitude Test’. After this one gets a chance to join the Inns of Court.
  • The Inns of Court is a professional association for barristers, providing educational and social support. In total there are four inns in England.
  • After joining INS, you have to do vocational training, where you are taught things related to law.
  • After training, one has to do pupillage, which is like an internship. This happens under the supervision of a senior barrister.
  • After doing pupillage for one year, the barrister will tell you whether you are ready to work or not.
  • If you are ready then you can apply for Authorization to Practice.
  • Once you get Authorization to Practice, you can work as a barrister.

The annual salary of a barrister in Britain is approximately Rs 34 lakh. As experience increases, salary also increases.
