Justice Hima Kohli was a supporter of women’s rights, know what else CJI Chandrachud said on her retirement


Special Correspondent, New Delhi: Chief Justice DY Chandrachud said that Justice Hima Kohli has been a supporter of women’s rights and has always been vigilant about it. Justice Hima Kohli sat on the bench with Chief Justice Chandrachud on Friday. On the last working day of their tenure, the Justice traditionally sits on the bench with the Chief Justice. Justice Hima Kohli is retiring on September 1 and Friday was the last working day of her tenure and on this occasion she sat on the bench with the Chief Justice.

Chief Justice Chandrachud said about Justice Hima Kohli, who is sitting with him/her on the bench, that it is a moment of immense happiness for him/her that she is sharing the bench. The Chief Justice also mentioned the exchange of views with Justice Kohli on various serious issues and said that he/she also remembered her support on many occasions. The Chief Justice said that Hima Kohli is not only a female Justice but she is also a strong protector of women’s rights.Can an educated woman not be granted bail? Justice Kohli was highly praised

On this occasion, Attorney General R Venkataramani said that Justice Kohli devoted his/her entire life for justice. Supreme Court Bar Association President Kapil Sibal and Solicitor General Tushar Mehta also praised Justice Kohli on this occasion.

Profile of Justice Kohli

Justice Kohli was born on 2 September 1959 in Delhi. She received her schooling from St. Thomas School. After this, she did History Honors from St. Stephens. After this, she studied law from Campus Law Center DU. After starting advocacy, she became Additional Standing Council of Delhi Government. She was made Additional Judge in Delhi High Court on 29 May 2006. Justice Kohli was appointed Chief Justice of Telangana High Court on 7 January 2021 and after that he/she was sworn in as a Justice of the Supreme Court on 31 August 2021.

Important decisions of Justice Kohli

  • In a recent important decision, a bench headed by Justice Hima Kohli of the Supreme Court had approved that the release of an undertrial who has served one-third of the maximum sentence period should be ensured. In the Supreme Court, the Central Government had said that Section 479 of the Indian Civil Security Code (BNSS) would be applicable in the earlier case.
  • The Supreme Court bench of Justice Hima Kohli had said that the right to health is a fundamental right and under it, as consumer rights, people also have the right to know about the quality of the product which is being manufactured for sale or through the advertisement of that product etc.
  • On 17 October 2023, the Supreme Court did not recognize gay marriage. The Constitutional Bench of the Supreme Court refused to recognize gay marriage. A bench of five judges of the Supreme Court gave this decision unanimously. Also, the Supreme Court had said by majority that homosexual couples cannot adopt. This decision was given by a bench of Supreme Court Chief Justice DY Chandrachud, Justice SK Kaul, Justice S Ravindra Bhatt, Justice Hema Kohli and Justice PS Narasimha.
  • The hospital handed over the dead body of the father to another family. The relatives of the deceased (children) accused the hospital of negligence and the matter first came before the Consumer Forum and then the Supreme Court. The bench of Justice Hima Kohli of the Supreme Court held the hospital of Ernakulam, Kerala responsible for negligence in service in this case. The hospital was directed to pay Rs 25 lakh as compensation to the petitioner (relative of the deceased).
  • In an important decision, the Supreme Court has said that even if the accused gives a confessional statement in front of the Narcotics Control Bureau officer, it will not be considered a confessional statement. In its important decision, the Supreme Court had said that it is necessary to recover the narcotic substance from the accused.
