Judges should avoid using social media… Why did the Supreme Court say this?

New Delhi: The Supreme Court has expressed concern over the use of social media by judges. The Supreme Court on Thursday said judges should live a saint-like life and work diligently and should avoid using social media. The court said that judges should work hard and judges should not express any opinion regarding the decisions. This case is related to the dismissal of two women judges, who were removed from their jobs by the Madhya Pradesh High Court.

The matter is related to the dismissal of two judges

Justice B. V. Nagarathna and Justice N. Kotishwar Singh’s bench made this oral comment. The bench was hearing a case related to the dismissal of two women judges by the Madhya Pradesh High Court. The court remarked that there is no room for showmanship in the judiciary.

‘Judges should stay away from Facebook’

The bench said, ‘Judges should stay away from social media, especially Facebook. he/she should not comment on the judgments, because if the judgment is cited tomorrow, the judge would have already expressed his/her views in some form or the other. The bench further said, ‘This is an open forum…You have to live like a saint, work diligently. Judges have to make a lot of sacrifices. They should not use Facebook at all.

The female judge had posted on Facebook

Senior advocate R., on behalf of one of the dismissed women judges. Reiterating the views of the bench, Basant said that no judicial officer or judge should post any post related to judicial work on Facebook. The comments came after senior advocate Gaurav Aggarwal, who is an amicus curiae, presented before the bench various complaints against the dismissed woman judge. Aggarwal told the bench that the woman judge had also posted a post on Facebook.

Four judges were reinstated

Let us inform that on November 11, 2023, the Supreme Court had taken suo motu cognizance of the dismissal of six women civil judges by the state government due to alleged unsatisfactory performance. However, the Madhya Pradesh High Court on August 1 reconsidered its earlier proposals and decided to reinstate four officers Jyoti Varkade, Ms Sonakshi Joshi, Ms Priya Sharma and Rachana Atulkar Joshi with certain conditions, while the other two Aditi Kumar Sharma And Sarita Chaudhary was kept out of this process. The Supreme Court was considering the cases of judges who joined the Madhya Pradesh Judicial Service in 2018 and 2017.
