The Supreme Court has raised questions and strongly condemned the questioning of former IAS officer Anil Tuteja all night and showing his/her arrest at 4 in the morning in the Chhattisgarh liquor scam. A bench of Justices Abhay S Oka and Augustine George Masih said inappropriate behavior of agency officials would not be a ground to quash the arrest. The Supreme Court said in its order that one thing is troubling us very much in this matter, which we want to express.Why did the Supreme Court rebuke ED?On April 20, 2024, at around 4:30 pm, the petitioner was sitting in the ACB office in Raipur. First he/she was summoned to appear before the ED at 12 noon. While at the ACB office, he/she was given another summons to appear before the ED at 5:30 pm. Thereafter, petitioner Anil Tuteja was taken to the Enforcement Directorate office in a van. he/she was interrogated by the ED all night and was shown arrested at 4 in the morning.It is a case of interrogation all night and then arrest.The petitioner was sitting in the ACB office of Raipur on April 20, 2024 at around 4:30 pm. ED interrogated him/her the whole night and he/she was shown arrested at 4 in the morning. Senior advocate Abhishek Manu Singhvi, appearing for Tuteja, said that the Supreme Court had earlier on April 8 quashed the prosecution complaint filed by the ED in the ECIR. he/she said the ED filed a fresh ECIR three days later based on the same facts and materials.Tuteja's arrest is illegal - SinghviSinghvi told the Supreme Court that Tuteja's arrest was illegal as there was no need to detain him/her. Additional Solicitor General SV Raju, appearing for the agency, admitted that the authorities had gone beyond limits in this matter. he/she told the court that necessary measures have been taken to ensure that such incidents are not repeated.ED issued internal letterThe agency has issued an internal letter to its officials. According to this, the statements of the accused and witnesses are to be recorded during office hours, while in special circumstances late night interrogation is to be avoided. In the previous hearing, the bench had raised concerns over the manner in which PMLA was implemented.The bench had made it clear that arbitrariness will not be allowed in taking action against the accused in violation of fundamental rights.
