Is CM Kejriwal being prevented from performing his/her duties from jail? When SC asked a big question

New Delhi: The Supreme Court has raised an important question whether there is any order prohibiting Delhi CM Arvind Kejriwal from discharging his/her duties due to being in jail? When the Supreme Court was told that the disposal of such files is getting delayed due to the absence of the CM’s signature in the case of premature release of convicts, the Supreme Court asked whether there is any order prohibiting the Chief Minister from working from jail? We want to find out because this will affect hundreds of cases. The Supreme Court has asked whether there is any rule that prevents jailed CM Arvind Kejriwal from disposing of the file related to the exemption of premature release of prisoners? The lawyer of the Center and the Delhi Government has said that he/she will take instructions in this matter and inform the court. This case came up for hearing before a bench headed by Justice AS Oka of the Supreme Court. Actually, the application for premature release of a prisoner has to be signed by the CM. The CM’s signature should be there before the file goes to the LG. Then the bench of Justice Oka of the Supreme Court asked this question. The matter was raised before the Supreme Court that due to lack of signature of the CM, the file is pending and there is delay in the case of premature release.

What did the Supreme Court ask the Delhi government

On Friday, the Supreme Court questioned the Delhi government’s lawyer and asked him/her to tell whether there is any restriction against the CM for signing the file related to the premature release case? Is there any such restriction that CM Kejriwal cannot sign such a file? On this, Additional Solicitor General Aishwarya Bhati and Delhi government’s senior advocate Archana Dev, who appeared on behalf of the central government in the Supreme Court, said that they will take instructions in the matter and inform the court.

‘You tell us what the rule says in this case?’

During this, the apex court asked that you tell us what the rule says in this case? If needed, we will use Article 142 of the Constitution because such a case cannot be stopped. We can pass an order using our special power. Kejriwal has been in jail since March 21. he/she was arrested by ED and CBI. he/she has got bail in the money laundering case but he/she is still in jail in the corruption case. After hearing his/her bail plea, the Supreme Court has reserved the decision.
