Investigation of exploitation case in Malayalam Industries continues, Supreme Court refuses to interfere in High Court’s decision

There was a lot of uproar in Malayalam Film Industries over sexual abuse case last year. In this case, Justice Hema Kamtethi was formed to investigate sexual abuse of women in a large number of women in the Malayalam film industry. Now the Supreme Court has refused to intervene in the directive of the Kerala High Court. A bench of Supreme Court Justice Vikram Nath, Justice Sanjay Karol and Justice Sandeep Mehta said that if a cognizable offense of a cognizable offense If information is received, the police officer is obliged to take action under the law. The court made it clear that no instructions could be given to stop the police investigation.

The statements were instructed to make the basis for FIR

The Supreme Court dismissed special permission petitions filed by the filmmaker and two actresses. The petitioners challenged the Kerala High Court’s October 2024 decision, directing the statements made before the Justice Heema Committee to make the basis for FIR.

The Supreme Court said that the Division Bench of the Kerala High Court is monitoring the investigation. If the people who make a statement in front of the committee feel that they are being harassed by the Special Investigation Team (SIT), then they can file their complaint before the High Court. The Justice Hema Committee was formed to investigate the sexual abuse of women in the Malayalam film industry.

The producer challenged the High Court order in the Supreme Court

The Kerala High Court on October 14, 2024 directed that the statements made before the committee will be considered information under Section 173 of the Indian Civil Protection Code, 2023 (BNSS) and the SIT would have to take necessary action. The film producer challenged the High Court order in the Supreme Court and later two women actresses also moved the Supreme Court.

Investigation of cases of sexual abuse of women will continue

The report of the commission raises questions on many such incidents that took place inside the film industry, which is under question of the work culture of the Malayalam film industry. According to the report, many women working in Malayalam have alleged that they are misused before they start work. The report also said that the Malayalam film industry is under the control of some makers, directors and actors and they are all men. They control the entire Malayalam film industry and dominate those working there.
