In the Kolkata doctor case, CJI’s sharp questions will definitely hurt Mamata Banerjee, what should she not have done?

New Delhi: The Supreme Court has taken a tough stand in the case of rape and murder of a 31-year-old trainee doctor in Kolkata. The Supreme Court, extremely angry with the Mamata Banerjee government of West Bengal, has announced that we are going to form a National Task Force on the safety of doctors. This task force will be formed under the supervision of the court and doctors will also be included in it. In the Kolkata doctor case, a bench of Justice JB Pardiwala and Justice Manoj Mishra, headed by Chief Justice (CJI) DY Chandrachud, took suo motu cognizance and heard the case. The Supreme Court has strongly reprimanded the Mamata Banerjee government of West Bengal in this case. Calling it a serious matter, some sharp questions have also been asked, which can hurt Mamata Banerjee. That too when the entire opposition is on the offensive and her own ally party has also pulled up in this matter. Let us understand from the experts what the Mamata government should not have done in this matter?

Allowing a crowd to enter a crime scene means damaging evidence

CJI DY Chandrachud said in a very harsh tone that why did the police not protect the crime scene? How did thousands of people enter the hospital after doing RG? Why was a crowd of 7,000 people allowed to come inside? Supreme Court advocate Anil Kumar Singh Srinet says that the hospital where this heinous crime was committed against the doctor was a crime scene. The crowd going to such a place means damage to the evidence. In such a situation, how can anyone be held guilty? It was the responsibility of the Mamata Banerjee government to protect the crime scene, which it failed to do.

Was Mamata Banerjee Modi’s target? Why did he/she say in a subtle way on the pretext of Kolkata doctor case… Take such crimes seriously

Joining the principal in the middle of the investigation raises suspicion

CJI has also asked the question that why did the principal call the doctor’s case a suicide? Also, why was the principal made to join another college? CJI said, CBI should file a status report in this case by Thursday. The investigation is currently in a delicate phase, so the report should be given directly to the court. Advocate Anil Singh says that in such cases, when the investigation is going on, any such action by the state government at that time can put it in the dock. Mamata government should not have done such a thing at all. This raises doubts about the intentions of the state government, which can go against it in the court.

Delay in FIR increases the possibility of tampering with evidence

Justice Chandrachud also asked what was the principal doing? Why was the FIR registered late? The body of the doctor was handed over to the parents late. What is the police doing? This is a serious matter. The CJI has appealed to the striking doctors to trust us. Understand that the health care system of the entire country is with you. Advocate Anil Singh Srinet explains that if there has been a murder or criminal case, it is mandatory to register an FIR immediately. In such cases, delay in FIR creates scope for tampering with evidence and evidence can also be influenced.

Revealing the identity of the victim is also a crime

CJI said that we are concerned about the victim’s identity being exposed. Showing the victim’s photo and her body after post-mortem is worrying. We are very concerned about the victim’s photos and name being circulated on social media. The victim’s identity was revealed everywhere, whereas this should not have happened. According to Anil Singh, the Supreme Court’s guideline in this matter is that revealing the victim’s identity on print, electronic or social media is a crime.

Law and order in the state is the responsibility of the states, Mamata government is surrounded

According to Advocate Anil Kumar Singh, the responsibility of maintaining law and order in any state is that of the respective state government. The Union Home Ministry is responsible for matters related to the internal security of the country. It enforces law for the criminal justice system. The police force in the country has been entrusted with the responsibility of maintaining public order and preventing and detecting crimes. Every state and union territory of India has its own police force. The state police has the responsibility of maintaining law and order. In such a situation, the Mamata Banerjee government has been completely surrounded by these comments of the Supreme Court.
