If you win then EVMs are fine and if you lose… petition for ballot paper elections rejected in Supreme Court


New Delhi: The Supreme Court rejected the petition in which the petitioner had filed an application asking that instructions should be given to conduct voting in the country through ballot. Petitioner Dr KA Paul had filed a PIL saying that the Election Commission should also be directed to disqualify those candidates who are found guilty of distributing liquor and giving other inducements during the elections. In the petition, apart from conducting the voting through ballot, many other guidelines were also requested. The Supreme Court, while rejecting the petition in this matter, said that if you win the election then EVM remains correct. In case of loss, there is an allegation of EVM malfunction. The court said that the petitioner in the case was not a political party.

Justice Vikram Nath made sharp remarks while dismissing the PIL and said that when you win the elections, there is no fault in the EVMs. But when you lose, EVM tampering is alleged. When Chandrababu Naidu lost, he/she said that there could be a glitch in the EVMs. Now this time when Jagan Mohan Reddy lost, he/she also said that EVMs have been tampered.

What did the petitioner say in the Supreme Court

The Supreme Court told the petitioner that you have filed a PIL earlier also, where does this idea come from. The petitioner said that he/she had returned from the Global Peace Summit in Los Angeles. In this PIL, I have got the support of 180 retired IPS and IAS and retired judges. The petitioner said that he/she is the president of an organization which has saved more than three lakh orphans and 40 lakh widows.

Voting through ballot paper in 155 countries – petitioner

Justice Nath asked why you want to get involved in these political matters. On this the petitioner said that this PIL is not political. If seen, voting is done through ballot paper in 155 countries around the world. Voting is done through ballot paper in all democratic countries. The petitioner said that Tuesday, November 26, is Constitution Day and due to voting through EVMs, the right to equality, expression of opinion and life is being violated.

Court rejected PIL

On this, Justice Nath of the Supreme Court asked that if political parties do not have any problem with this, then what problem do you have? Petitioner Dr. Paul said that money is being distributed in the elections. A businessman has given Rs 1200 crores to all the big political parties. The bench then said in oral remarks that we never received any money for any election. The bench rejected the petition and said that this PIL is not maintainable.
