From 26 June 2024, New Zealand has made some changes to its visa rules, which may put some foreign workers and their families in trouble. The good thing is that these changes have been made to simplify the visa application process, which may make the way to New Zealand a little clearer for you.
But, one important change is that people who have an “Accredited Employer Work Visa” (AEWV) of ANZSCO Skill Level 4 or 5, that too without any residency, will no longer be able to sponsor their partners and children on work, visitor or student visas. In simple words, New Zealand now wants to give visas to those who have a solid plan to stay there, such as a good job or intention to stay there in the future. On the other hand, if we talk about the changing visa rules in New Zealand, if your partner is working in a company there on a work visa, then he/she can no longer sponsor a work visa for you. But this applies only to those people whose work visa is of a special type, which is called “Accredited Employer Work Visa (AEWV)”. That too only if their job falls under ANZSCO level 4 or 5 and there is no way to get residency.

The good thing is that these new rules will not apply to those who are already living in New Zealand on partner or dependent visas. Also, if your visa application is still pending, you do not need to worry. Your application will be processed under the same rules that were applicable when you applied.

If you applied for visas for your family before 26 June 2024, you can still sponsor them under certain conditions. These conditions also apply if your partner or child already has a visa based on their relationship with you, or if their work, visitor or student visa application was in progress before the rule change and was later approved.

If you are an AEWV holder with ANZSCO Skill Level 4 or 5 and your earnings are less than $47.41 New Zealand dollars per hour, you can still sponsor a visa for your partner or children. On the other hand, if you are on a worker visa and want to sponsor a worker visa for your partner, you must earn at least $29.66 New Zealand dollars per hour. For a Worker Visitor Visa for children or a Dependent Child Student Visa, you must show proof of earning at least $43,322.76 New Zealand dollars annually.

If you want to go to New Zealand and work and bring your partner along, you must earn more than New Zealand Dollars (NZD) 29.66 dollars per hour. This rule will apply to those applying for a partner visa after 26 June 2024. Even if your earnings are less than this, there is no need to panic! You can get a worker visitor visa for your partner. Apart from this, if your earnings are more than New Zealand Dollars (NZD) 59.32 dollars per hour or your job is included in the Green List and you have the required qualifications for that particular role, then you can also apply for an open work visa.
