If our order is disobeyed, those responsible will go to jail… Action taken despite order in Gujarat, Supreme Court angry

New Delhi: The Supreme Court on Friday said that if it finds that the authorities have violated its order regarding demolition in Gujarat, then it will pass an order to restore the demolished structures. The bench said that if we feel that they are in contempt of our order, we will not only send them to jail but will also ask them to restore all this. The bench said that its previous order applies equally to everyone. The Supreme Court has sought a response from the Solicitor General on the petition and has fixed October 16 for hearing.

A bench led by Supreme Court Justice BR Gavai heard the contempt petition filed in the case of alleged violation of the court’s September 17 order. Meanwhile, the Supreme Court has made the above comment. In fact, the Supreme Court had said in the previous order that the properties of the accused and other people across the country should not be demolished without the permission of the court. After that the petitioner filed an application saying that despite the order of the Supreme Court, demolition action was taken in Gujarat.‘This falls within the exception’
Advocate Sanjay Hegde of the petitioner Samast Patni Muslim Bail argued that this demolition action has taken place despite the court order. Solicitor General Tushar Mehta, appearing for Gujarat authorities in the Supreme Court, said that the structure was about 340 meters away from the Somnath temple adjacent to the sea and it falls under the exception.

If we find that officials have violated his/her orders regarding demolition in Gujarat, then he/she will pass orders to restore the demolished structures.

In its order last month, the court had said that we make it clear that our order will not be applicable if there is any unauthorized structure adjacent to any public place such as a road, footpath, railway line or river or any water body.
