If men had menstruation, they would have understood… Supreme Court made important comment on the dismissal of women judges.


New Delhi : The Supreme Court expressed pain and displeasure while hearing the case of termination of Madhya Pradesh women judges. The apex court on Tuesday criticized the state High Court for terminating the services of women civil judges in the state and refusing to reinstate some of them.

A two-judge bench led by Justice BV Nagarathna and Justice N Kotishwar Singh said that if only men had menstruation, then they would understand. he/she indirectly referred to the indifferent attitude of the Madhya Pradesh High Court in terminating the services of women civil judges in the state and refusing to reinstate some of them.

Questions on target to settle cases

Justice Nagarathna said that especially for women, if they are suffering physically and mentally, don’t say they are slow and send them home. There should be the same standards for male judges and judicial officers, we will see then, and we will know what happens. he/she said how can you create a target unit (for disposal of cases) for the district judiciary? The apex court fixed December 12 for further hearing in the case.

Earlier, on July 23, 2024, the same bench of the Supreme Court had asked the Madhya Pradesh High Court to reconsider within a month its decision to terminate the services of judicial officers. Also asked to reconsider the representation of the affected judge.

What is the matter?

On behalf of the Madhya Pradesh government, the Supreme Court had taken suo motu cognizance of the issue of termination of service of six judges in June 2023. The Supreme Court was hearing this case since January this year. In the case, the services of Civil Judge, Class-II (JR Division) of Madhya Pradesh State Judicial Service were terminated.

The State Law Department of Madhya Pradesh Government had passed an order to dismiss these six women judges. The reason for this was that his/her performance during the probation period was found unsatisfactory in the meeting of an administrative committee and the full court.
