What will Chandrachud do after retirement, told the plan

DY Chandrachud said that he/she believes that once a person retires from the post of CJI or judge, people still consider him/her as a judge or CJI. In such a situation, even after retirement, their work should be such that it reflects their responsibilities. he/she said that if I hold any post, I believe that even after retiring from the post of CJI or judge, people will still consider you as a judge or CJI. Society expects a certain kind of behavior from you. What I can say for myself is that I should remain loyal to the position I have held so far and this should be reflected in whatever I do after retirement.

‘Retired judges can work in tribunal’

CJI Chandrachud said that retired judges can work in many tribunals under parliamentary laws like National Green Tribunal, National Consumer Disputes Redressal Commission and Telecom Disputes Tribunal. Pointing out possible roles for a Supreme Court judge or CJI, Justice Chandrachud said the nature of the cases coming before these tribunals is such that they are of great importance. Hearing these cases requires persons of utmost integrity and expertise. This is the reason why former judges, especially judges of the Supreme Court and High Court, are appointed to these posts.

Chandrachud explains why judges hesitate to play a bigger role

However, Justice Chandrachud also pointed out certain shortcomings in such cases due to which retired judges are reluctant to play a role in tribunals or grievance redressal. he/she said that joining any such post can be linked to his/her actions and decisions taken during his/her tenure. Justice Chandrachud said that it is this kind of discussion that prevents many judges from accepting roles after retirement. he/she called it an unfortunate situation.

What challenges did Justice Chandrachud mention?

Justice Chandrachud said that if the most honest and expert judges are not in these roles, it will affect the development and transformation of the country’s economy. Describing this as a serious concern, he/she said that this is because the functioning of these tribunals is necessary to settle disputes which are becoming increasingly complex. Therefore, I believe that the media should reconsider how it portrays retired judges accepting these roles. We need former judges in these positions to ensure that the process is fair and trustworthy.

Open talk on role after retirement

Justice Chandrachud said that due to the authority of the Parliament to decide to create such roles for retired judges of the Supreme Court, questions should not be raised on the judge who is performing this role. Expressing confidence in always being seen as a CJI or a judge, Justice Chandrachud said that the society expects a certain kind of behavior from you. What I can say for myself is that I must remain loyal to the position I held and this should be reflected in whatever I do after retirement. It is clear from Justice Chandrachud’s reply that if he/she takes up such a role after retirement, his/her actions in that capacity will reflect his/her service as CJI.
