‘If action is not taken then…’ Bar Association writes letter to CJI on insulting lawyers in courts

New Delhi: The All India Bar Association has written to the Chief Justice of India (CJI) DY Chandrachud, urging him/her to take cognizance of the recent incidents of ‘judicial misconduct’. The association says that these incidents have had a deep impact on the legal fraternity. The letter said immediate action should be taken by high court judges to eliminate ‘disrespect and misconduct’ towards senior lawyers, advocates and litigants in courts. The letter asked Justice R Subramanian of the Madurai bench of the Madras High Court to One related incident has been specifically mentioned. The allegation is that he/she behaved disrespectfully towards a senior advocate, MP and advocate-on-record ‘without any reason’. President of the Bar Association, Adish Aggarwal expressed disappointment in the letter that despite various efforts by the association, no concrete action has been taken in this regard.

he/she further wrote in the letter that as the Chief Justice of India, it is extremely important that you ensure that senior advocates and other advocates are treated with utmost respect and dignity by the Honorable Judges of the High Court during the court proceedings. Let’s do. he/she further said the Madras High Court incident happened during the tenure of Justice Chandrachud. If no action is taken in this matter, it will send a wrong message. It would seem that the CJI does not care about the dignity of lawyers. The letter asked why no action was taken against the guilty judge of the Madras High Court, including his/her transfer?

The letter also said that incidents of judicial misconduct against lawyers are now becoming common. The President of the Bar Association further wrote in his/her letter that no action is taken against such judges. They are not made aware of their responsibilities. This encourages them and they continue doing the same. This spoils the relationship between the judiciary and lawyers.
