How much punishment will the CISF woman jawan get for slapping MP Kangana? Know what the law says

New Delhi: Bollywood actress and BJP leader Kangana Ranaut has defeated Congress candidate Vikramaditya Singh from Mandi Lok Sabha seat of Himachal. Kangana won the election by a margin of 74 thousand 755 votes. But the joy of Kangana’s victory faded when a CISF woman soldier slapped her. MP Kangana Ranaut was slapped by a CISF woman soldier at Chandigarh airport. The name of the guard who slapped Kangana is Kulwinder Kaur. Kangana was coming to Delhi by Vistara Airlines flight to attend a BJP meeting. When she was going for boarding, Kulwinder Kaur, who was on duty there, slapped her. The accused woman soldier says that she was very angry with Kangana Ranaut’s statement on the farmers’ movement. On the other hand, Kangana has posted on social media that the woman has abused her along with slapping her. The woman constable has been suspended and an FIR has been registered against her. This matter is now gaining momentum. Some farmer leaders have started politics on this matter. Here it is very important to know that when someone slaps an MP or misbehaves with him/her, what is the punishment for that.

What does the law say?

In India, slapping comes under the category of crime, for which there is a provision of punishment. In such cases, the police register a case under section 323 of the IPC. Under section 323 of the IPC, if someone hurts or harms someone on his/her own will, then he/she can be jailed for 1 year. Apart from this, there can be a fine of Rs 1,000 or both. If it is proved that someone misbehaved at the time of the incident and then committed this incident, then the court can also change the punishment.

The investigation report will decide the punishment sections

If a person uses criminal force or symbolic attack to scare another person and no harm is caused to him/her but the victim is frightened, then the accused will be considered guilty under section 358. Section 352 of the Indian Penal Code (IPC) says, if a person attacks the victim without any provocation or uses criminal force, then in such cases, three months imprisonment and a fine of up to Rs 500 has to be paid or both imprisonment and fine can be imposed. However, after the investigation report comes out, it is decided which sections are to be applied. However, service related action can also be taken against the CISF woman jawan who slapped Kangana.
