How can Indian students-workers stay in Canada even after their visa expires? Know the process here

Explanation of Canada’s vested position: Lakhs of Indian students and workers are living in Canada. According to Immigration, Refugees, Citizenship Canada (IRCC), out of 3.74 lakh foreign students, 1.37 lakh Indian students have received study permits till August 2024. This is 36.7% of the total foreign students. Indians constitute the largest number of foreign students studying in Canada. If statistics are to be believed, an estimated 4.27 lakh Indian students were studying in Canada in 2023.
Every year lakhs of Indians are moving to Canada, which includes not only students but also people going for jobs. Because of this, a question that remains among many students is what is the best way to live in Canada permanently? If someone applies to extend their temporary residence (called student-workers temporary residents) before it expires, they can remain in the country pending a decision on the application. For this he/she will need ‘Implied Status’.

What is ‘Implied Status’?

According to IRCC, Implied or Maintained Status allows temporary residents to remain in Canada legally under the terms of their original permit. They are allowed to remain in Canada until a decision is taken on their application. If a person is in the last phase of his/her study visa or work visa and then applies for applied status. Even if his/her permit expires during this period, he/she will still be allowed to stay in the country. he/she gets assurance from the government that he/she can stay legally until the decision on his/her application is taken.

When applying for Implied Status, always remember that temporary residents must apply for an extension at least 30 days before their current permit expires in order to maintain their status without interruption. However, people are still eligible if they apply a day before the visa expires. But it is better to apply early. If a student’s application is being reviewed and his/her or her residence permit in the country has expired, he/she or she can still study.
