Give Rs 1.75 lakh per month to maintain standard and lifestyle… Supreme Court ruled in favor of the woman

New Delhi: In a case, the Supreme Court directed a man to pay alimony of Rs 1.75 lakh per month to his/her wife during divorce proceedings. Also said that the lifestyle of the woman during her married life should be maintained as standard. A Supreme Court bench led by Justice Vikram Nath said that the petitioner woman was accustomed to a good lifestyle in her in-laws’ house during her married life. In such a situation, as long as the divorce petition is pending, the woman has the right to maintain the same lifestyle. The petitioner woman was married on 15 September 2008 according to Christian customs. The woman’s husband had a son from his/her first marriage. Both of them did not have any children in the present marriage. In the case, the woman’s husband filed a divorce petition in 2019. It formed the basis of cruelty. Also said that there is no harmony between the two. In this case, during the hearing of the divorce petition, the woman demanded alimony of Rs 2.5 lakh per month. The woman said that her husband has a good income and has a medical practice. Also there is property and rents come from it.

In this case, the Family Court in Tamil Nadu directed the woman’s husband to pay Rs 1.75 lakh per month to his/her wife as alimony during the divorce proceedings. When the matter went to Madras High Court, the maintenance allowance was fixed at Rs 80 thousand. The woman challenged this decision in the Supreme Court. The Supreme Court rejected the High Court’s decision and said that the High Court did not consider the entire income of the woman’s husband. The Supreme Court, while upholding the decision of the Family Court, directed the woman’s husband to pay Rs 1.75 lakh per month as alimony.

Adequate living allowance is necessary for a respectable life
The Supreme Court has ruled that it is the duty of the husband to provide financial support to the wife living separately. For this he/she will have to do even physical labour. Adequate living allowance is necessary to live a respectable life. It is the wife’s right to have the same lifestyle that she enjoyed in her husband’s house. When deciding the maintenance allowance, social status should also be considered. Expenses for running a life do not mean that one gets an animalistic life and goes astray for basic things. The Supreme Court has issued various guidelines regarding maintenance allowance in its decisions given from time to time. The decision given by the Supreme Court in the present case will become an example in the coming days.
