From AMU to Madrasas… CJI Chandrachud will give decisions in these 3 big cases in the last days of his/her retirement!

New Delhi: Supreme Court Chief Justice DY Chandrachud is retiring on November 10. he/she has five working days before retirement, in which he/she is going to give decisions in many matters. Among these, UP Madrasa Act, Aligarh Muslim University case and the case related to cutting of trees in Delhi are important. Chief Justice Chandrachud’s last working day is Friday, November 8. The bench led by Chief Justice DY Chandrachud is going to give its verdict on the petition filed against the High Court’s decision to repeal the UP Board of Madrasa Education Act. The Chief Justice’s bench had reserved its decision on this. The Supreme Court is hearing the case against the decision of the Allahabad High Court, in which the High Court had rejected the UP Madrasa Education Board Act 2004, terming it unconstitutional.

What will be the status of AMU?

The issue of minority status of Aligarh Muslim University. The case has been heard before a seven-judge constitutional bench headed by CJI Chandrachud and the Supreme Court has reserved the verdict. In 1967, the Supreme Court had said in the decision given in Aziz Pasha case that AMU is not a minority institution. This decision was of a bench of five judges. After this, the law was amended in the Parliament in 1981 and the AMU Act 1920 was amended and the minority status was restored to AMU. The matter reached Allahabad High Court and then Supreme Court.

Decisions on these matters will also be important

  • The case of cutting of trees in the Ridge area of ​​Delhi is being heard. The bench led by CJI Chandrachud has asked DDA Chairman and Delhi LG VK Saxena and former DDA Vice Chairman to tell when they got the information about the cutting of trees. The next hearing is to be held on November 5.
  • Can a person holding a license to drive a light vehicle (LMV) drive a transport vehicle of the same weight? The decision of the bench led by the Chief Justice is to be taken on this question. The Central Government had told the Supreme Court that it is taking suggestions in the matter and talks are going on with the state governments in this regard.
