Provision under immigration and foreign bills
These provisions are from the Immigration and Foreign Bill, 2025. It is to be introduced in the Lok Sabha in this session. It aims to cancel four acts with overlapping provisions on the subjects related to immigration and foreigners and consolidate them in a single, comprehensive law. These four acts are Foreign Act, 1946; Passport (Admission to India) Act, 1920; Foreigners Registration Act, 1939; And immigration (carrier liability), 2000.
How much is the fine right now
So far, the maximum punishment for a foreigner entering the country without a travel document including a valid passport or visa is a five -year jail and fine. The maximum punishment for those entering a fake passport is eight years in jail and a fine of up to Rs 50,000. The Bill also provides for making all higher educational institutions and universities liable to share information about any foreigner with the specified registration officer for such foreign class. This provision will also be applicable to all hospitals, nursing homes and other medical institutes who have the facility to stay in the campus.
Under the Bill it is proposed that any foreign person stays over the period of his/her visa or violates the terms of the visa, or if it enters a prohibited or restricted area, then he/she is in jail for three years or 3 A fine of up to lakhs of rupees or both will be sentenced. The bill also proposes that if a foreign person comes here without a valid passport or travel document/visa, the carrier bringing it will be held responsible.
There will be a chance to keep the side
The immigration officer can impose a fine of up to Rs 5 lakh on the carrier. However, his/her side will be heard before. If the penalty is not filled, it can be charged by seizing the carrier or taking into custody, which may be a plane, ship or any other means of transport.
In the proposed bill, the Central Government to ban the entry of any foreign or foreign class, not to depart from India, not enter any specified field, go out of India at its expense and allow it to take their photo and biometrics. Powers have been provided.
