Dr. Khurana’s appointment canceled on the post of chairman of National Homeopathy Commission, why Supreme Court ordered

New Delhi : The Supreme Court has canceled the appointment of Dr. Anil Khurana as the President of the National Commission for Homeopathy. The Supreme Court on 12 February accepted the civil appeal challenging the appointment of Dr. Anil Khurana as the chairman of the National Homeopathy Commission in this case.

Appointment was not in accordance with rules

A bench of Supreme Court Justice Dipankar Dutta and Justice Manmohan said that the appointment of Dr. Khurana was not in accordance with the law. The court has directed him/her to step down within a week. The apex court directed Dr. Khurana to withdraw from the post, but was given a week’s time so that he/she could fulfill his/her responsibilities.

However, during this time he/she cannot take any decision related to financial policies. The Supreme Court has directed to start the process of appointing the new president soon. his/her benefits will not be affected by Dr. Khurana based on the service done so far.

Challenge to appoint in Karnataka High Court

The petitioner himself was also himself the applicant for the post. he/she first challenged the appointment of Dr. Khurana in the Karnataka High Court. It was argued that the provisions of Section 4 (2) and 19 of the National Homeopathy Commission Act, 2020 were not followed in the appointment. The candidate for the post of president should have a postgraduate degree in homeopathy. At least 20 years of experience is necessary. Of this, at least 10 years of healthcare delivery, growth and development of homeopathy, or work in the field of education.

Now the Supreme Court rejected the Double Bench of the Karnataka High Court and accepted the petitioner’s application. The court also compelled that Dr. Anil Khurana’s appointment was not in accordance with the law. Now they have to step down within a week. Also, it has been directed to appoint a new president soon.
