Does the slogan of ‘Jai Shri Ram’ in the mosque hurt religious sentiments? Supreme Court will decide

New Delhi: The Supreme Court will hear an important case on Friday. This case challenges a decision of the Karnataka High Court. The High Court had quashed the criminal action against those who raised slogans of ‘Jai Shri Ram’ in the mosque. The High Court said that this did not hurt religious sentiments. The petitioner is Haider Ali. his/her lawyer is Javedur Rahman. The matter is of September 24, 2023. Some people had raised slogans of ‘Jai Shri Ram’ at Badaria Juma Masjid in Aitur village. The police had arrested two people, who were later granted bail. The Karnataka High Court had quashed the lower court proceedings on September 13. The petitioner says that ‘the police investigation was not completed. Not all the evidence had come before the court. Therefore the decision of the High Court is wrong. Trespassing into a mosque is a crime. Raising slogans of ‘Jai Shri Ram’ can create communal tension.

Haider Ali has challenged the decision of Karnataka High Court in the Supreme Court. The High Court had on September 13 canceled the proceedings of the Puttur court in Dakshina Kannada district. The police had arrested two people, who were later granted bail. On November 29, the High Court had stayed the action of the lower court. The accused had demanded quashing of the criminal proceedings. The High Court gave him/her relief on 13 September.

What does the petitioner say?

The petitioner argues that the Hart Court erred in quashing the action. The police investigation was not completed. All the evidence could not come before the court. Forcibly entering a mosque is a crime. Raising slogans of ‘Jai Shri Ram’ inside the mosque can be a statement inciting communal riots. This is also a legal offence. The petitioner said, ‘This incident happened inside a mosque. The lives of Muslims were in danger. The High Court should have allowed the police to complete the investigation of the case before passing the interim order.

What will the Supreme Court decide?

This matter will come before the bench of Justice Pankaj Mittal and Justice Sandeep Mehta today. It remains to be seen what verdict the Supreme Court gives in this matter.
