Controversy over Allahabad High Court judge’s statement that ‘law according to majority’, SC asks for report

New Delhi: Taking cognizance of the speech given by Allahabad High Court Justice Shekhar Kumar Yadav in a program of Vishwa Hindu Parishad (VHP), the Supreme Court has sought complete information from the Allahabad High Court. On December 8, at a provincial conference of the VHP’s legal wing and the High Court unit at the Allahabad High Court, it had said that the main objective of the Uniform Civil Code (UCC) is to promote social harmony, gender equality and secularism. According to the majority opinion of Justice Yadav, many people have expressed strong objection to the video of Justice Yadav’s alleged statement including the law.

Detailed report sought from High Court

On the report published in the newspaper, the Supreme Court has asked the High Court to give detailed information on this issue. CJAR (Campaign for Judicial Accountability and Reform) has written a letter to Chief Justice Sanjiv Khanna demanding an in-house inquiry against Justice Yadav. CJAR convenor Advocate Prashant Bhushan said in the letter, Justice Yadav gave a speech supporting UCC which is controversial. his/her participation in the VHP program and his/her statements are a violation of judicial impropriety.

Impeachment should be brought against Justice: Sibal

Senior advocate and Rajya Sabha MP Kapil Sibal demanded impeachment against Justice Shekhar Kumar Yadav. Sibal said, he/she wants people from the ruling party to join us, and we should come together and impeach this judge. This kind of speech by a judge hurts the dignity of the judiciary. This may weaken public confidence. There is no other option except the impeachment motion. This is hate speech in every sense of the word. Sibal described the incident as a serious challenge to the impartiality and democratic values ​​of the judiciary.

Even if I have said this, I am not sorry: VHP Chief

VHP chief Alok Kumar said on Tuesday, we had called the judge as a speaker to speak on UCC. Such awareness conferences will continue to take place. The exact nature of the judge’s comments on the ‘majority’ is not known. I was not in the Prayagraj meeting, but even if the judge had said this about the majority, I do not find anything objectionable in it. If he/she (Justice Yadav) has said something like this, I will not regret it. If the majority has a particular viewpoint, others should not make an issue of it.
