New Delhi. After the implementation of the Consumer Protection Act 2019 in the country, consumers have got many rights. Especially during the journey, fine is also being imposed on the complaint of AC, Bedroll, Food and Cleanliness of the train. Recently, taking the help of this law, a person collected a fine of Rs 20,000 from the Railways. Not fixing the faulty AC in the Shatabdi Express train cost the Railways dearly. The Delhi Consumer Commission has asked the Railways to pay a fine of Rs 20,000 on this matter as well as Rs 10,000 for fighting the case of the complainant.
Let us tell you that even after the complaint of a passenger in this case, the AC was not fixed in the train. The complainant had imposed a fine of Rs 20,000 on the Railways in the Delhi Consumer Commission under the Consumer Protection Act 2019. In such a situation, if you are traveling by train as well as by airplane or any public transport, then you can complain to the concerned department in consumer courts.
Passengers traveling by air can also register their complaints in the Consumer Commission.
Action taken on passenger’s complaint
Recently, the Delhi Consumer Commission rejected the claim of the Railways, stating that the Consumer Forum has no right to hear complaints of any inconvenience during the journey. It was argued on behalf of the Railways that a passenger should complain to the Railway Tribunal to claim any kind of complaint on the Railways.

People traveling in the air conditioning compartment in the train are often worried about the bad AC. When it comes to complaints, people keep silence. But, in recent times, many such cases have come to the fore, when people have started complaining. However, people have the apprehension that they will have to visit the court on complaining. But, in the year 2019 itself, the Modi government implemented a new Consumer Protection Act in the country. After this, consumers started getting many rights and facilities.
Supreme Court’s response
The decisions given by the Consumer Commission remain intact even in the Supreme Court. Train delay is also now considered as deficiency of service under the Consumer Protection Act. For this, the passenger has the option of going to the consumer court and getting compensation. Because, in the train ticket issued by the Railways, the time of departure and arrival of the concerned train is also given.

Air passengers can also complain here
Similarly, while traveling by aeroplane, many problems come with you. Keeping this in mind, the Civil Aviation Ministry has prepared a charter regarding the rights of passengers. Passengers have been given many rights in this charter, whose purpose is to protect their interests. Under this charter, if the interests of the consumers are not taken care of, then the passengers traveling by air can also lodge their complaint in the Consumer Commission.

Under the Consumer Protection Act-2019, those who sell substandard goods, those who give misleading advertisements also have to go to jail. Under this law, those who sell substandard goods may have to pay six months in jail and a fine of lakhs of rupees. E-commerce companies have also come under the purview of this new law. Now the consumer will have the right to file a complaint in any consumer court.
