Cannot withhold compensation for years after acquiring land…Supreme Court tells Karnataka government


New Delhi: The Supreme Court has reprimanded the Karnataka government and said that it is wrong to withhold compensation after taking the land. Compensation for the land taken in 1986 will have to be paid at today’s market rate. Land was taken to build the city of Vijayanagara in Hinkal village of Mysore. About two acres of land of Jayalakshmamma and others was involved. The Supreme Court ruled in favor of the land owners.

The Supreme Court said that not giving compensation is a violation of ‘Article 300A’ i.e. the right to property. No reason was given for withholding compensation for more than 33 years. Justices Surya Kant and Ujjal Bhuyan accepted the arguments of advocate Anand Sanjay M Nooli, who appeared for land owner Jayalakshamma and others.

The Supreme Court ordered to give compensation at the market price of June 1, 2019. Compensation will have to be deposited within four weeks. Land owners will have to hand over the land after receiving compensation. After receiving compensation, the acquisition cannot be challenged. Advocate Anand Sanjay M Nooli had presented the side of the land owners. he/she said that despite notifications and awards, land owners were kept in the dark. Neither land was taken nor compensation was given.

What did the petitioner’s lawyer say?

The advocate said that the land owners are still in possession of the land and are paying taxes, electricity bills etc. This matter is related to property rights and responsibility of the government. The Supreme Court clarified that the government cannot postpone payment of compensation after acquiring the land. This decision is important for all those land owners whose land has been acquired by the government. However, they have not received proper compensation.
