Canadian study permit rejected, will still get entry into the country! Know what are the options for Indian students

Canada Study Permit Process: Foreign students need a study permit to study in Canada. However, many times students’ application for study permit gets rejected. Because of this, students become very upset. But they do not need to worry, because a program is run in Canada, through which students can get study permit even after rejection. The name of this program is ‘Study Permit Pilot Project’, which started from October 1, 2024.
Actually, the work of granting study permit in Canada is done by ‘Immigration, Refugee and Citizenship Canada’ (IRCC). This institute gives study permits to the students coming to study in the country. But many times study permits are also rejected, due to which students have to go to the Federal Court. Because of this it becomes a long process. However, to simplify this process, the Canadian Federal Court has started this new project. This can help in getting quick justice if study permit is rejected.

How can one apply for the pilot project?

If your study permit has also been rejected, you can then join the Federal Court’s study permit pilot project. For this, the consent of both IRCC and the student is necessary. Under this project, the judge can give the verdict without hearing. In this project, the applicant (student) and the respondent (IRCC) will not be required to give evidence through affidavit. An affidavit is a type of written statement in which new evidence is presented.

All documents will have to be submitted through the electronic filing system of the court. There is no additional fee to participate in this pilot project. However, any application for review against the decision will be subject to a fee of $50. If you have applied while living in Canada, then you will have to apply within 15 days of receiving the rejection letter. If you applied from outside Canada, you must apply within 60 days of receiving the rejection letter.
