Canada Work Visa: Job rules in Canada will change from November, know the new rules of post study work visa.

Canada Post Study Work Rules: Prime Minister Justin Trudeau’s government has taken a big decision for the students going and studying in Canada. The government has updated the ‘Post-Graduation Work Permit’ (PGWP) rules. The new rules will come into effect from November 1, 2024, in which new eligibility criteria have been created for PGWP. The Canadian government has created new regulations to deal with labor shortages in certain industries.
The Trudeau government also wants to ensure that students have knowledge of English as well as Canada’s second language, French. International students planning to live and work in Canada after graduation will now have to meet new requirements to obtain a PGWP, after which they will be able to obtain a work permit. The new rules have been made very stringent, due to which the problems of the students are going to increase.

Strict rules regarding language

The most important change in the PGWP rules is to make the Language Proficiency Test, i.e. the test proving knowledge of the language, mandatory. Students completing post graduation will now have to prove proficiency in English or French to be awarded the PGWP. For English, students will have to take any one test among CELPIP, IELTS and PTE. Students can take either the TEF Canada or TCF Canada exams to prove their proficiency in the French language.

Students will be eligible for PGWP only if they meet the minimum language benchmark based on their field of study and level of their degree. Students pursuing bachelor’s, master’s or doctoral studies must achieve Canadian Language Benchmark (CLB) Level 7 in four competencies: reading, writing, listening and speaking. These conditions have been kept so that students can easily join the Canadian workforce after post graduation.

People of these fields will easily get PGWP

Canada has made the new PGWP rules in such a way that the workforce can be increased in those sectors which have been suffering from shortage of workers for a long time. The updated guidelines state that students pursuing certain courses will have to link their studies to key sectors where Canada is facing a shortage of skilled workers. It includes the following sectors:

  • Agriculture and Agri-Food
  • healthcare
  • Science, Technology, Engineering and Maths (STEM)
  • Business
  • transport

Getting PGWP is going to be much easier for students studying courses related to these sectors. However, those from other fields, especially non-university programs, must meet these conditions to meet the work permit eligibility criteria. The thing to note here is that students studying Bachelors, Masters or Doctoral degrees do not need to study any other field.

How to apply for PGWP under the new rules?

Students have 180 days to apply for PGWP after completing their studies in Canada. However, if a student wishes to work before receiving the PGWP, he/she or she must obtain a valid study permit. During application, students will be required to show their degree or diploma, official transcript, or letter of completion from their institution proving that the student has completed their studies.

The updated rules also state that graduates can no longer apply for PGWP at the port of entry. Applications must now be submitted online from within Canada or from abroad. Additionally, those who wish to work in a sector where medical examination is required should opt for advance medical examination 90 days before applying for PGWP.

What to do if study visa expires before work permit?

If a student’s study permit expires before receiving the PGWP, they have 90 days to obtain a study permit. Students must submit both a PGWP application and fees to IRCC in order to receive their study permit. However, during this time, students cannot work until their study or work permit is approved.
