Can US citizenship by birth be abolished? Read important news related to millions of Indians

US Birthright Citizenship: America’s new President Donald Trump wants to change the rules of citizenship. he/she promised to do so even during the election campaign and now after winning the presidential election, he/she is continuously claiming to do so. Trump has said that he/she will end citizenship by birth as soon as he/she assumes office. However, it is not going to be so easy for Trump to end this policy, because many challenges are going to come before him/her.
‘Birthright Citizenship’ means that any person born in America automatically becomes an American citizen. This rule also applies to children whose parents are in the country illegally or are on tourist-student visas. According to Pew Research, the population of Indian-Americans in America is 48 lakh, out of which 16 lakh or 34% were born in America. Those of these people whose parents do not have a green card or citizenship may lose their citizenship if the rule is lifted.

What did Trump say on citizenship by birth?

In an interview with NBC, Trump said that he/she would end birthright citizenship after taking office. he/she said, “We’re going to end it because it’s ridiculous.” Trump and other opponents of birthright citizenship argue that it encourages people to come to the United States illegally. It also promotes ‘birth tourism’, in which pregnant women come to the United States specifically to give birth so that their children can obtain citizenship and then return to their home countries.

What does the US Constitution say about citizenship?

The US Constitution guarantees citizenship by birth. The 14th Amendment of the Constitution gives rules in this regard. It states, “All persons born in the United States, or naturalized citizens of the United States, are citizens of the territories belonging to the United States and of the State in which they reside.” The jurisdictional part creates a very narrow exception that today essentially applies only to children of accredited foreign diplomats.

Can Trump end citizenship rules?

The answer to this question is no. The President does not have the power to amend the Constitution. If Donald Trump wants to use his/her powers as President to abolish the rule of citizenship by birth through an executive order, he/she will face a challenge in the court. This is because any executive order passed through them would be a direct violation of the 14th Amendment of the Constitution.

Some Trump allies have suggested that the jurisdictional language in the amendment could be interpreted to exclude children of immigrants living in the country illegally. These children are the main target of demands to end citizenship by birth. However, so far the consensus among scholars and legal experts is that such an argument has little or no chance of winning in court.
