Big decision of the Supreme Court on the entire medical admission including MBBS, admission will not stop only on 40% disability!

MBBS NEET Supreme Court News Today: The Supreme Court has said that the fixed standard of only 40% disability does not stop anyone from getting medical education. No one can be stopped from pursuing a medical course merely on the basis of disability. Rather, for this there should be an expert report that due to disability the candidate is unable to do the course. The Supreme Court bench led by Justice BR Gavai had passed an order in this matter on September 18 and now explained the reason for this order in detail. .

Why did the court say this?

The Supreme Court had allowed a candidate to take admission in the MBBS course after the medical board had said that he/she was able to pursue medical education without any hindrance. The bench said that the capability of a disabled candidate to study in MBBS course should be examined by the Disability Assessment Board. A candidate cannot be declared ineligible for admission to the MBBS course merely on the basis of disability of the prescribed standard.

The top court said that ‘For this, the board will have to tell whether the disability will become a hindrance for the candidate in studying MBBS course or not.’

Actually, the Supreme Court has given this decision during the hearing on the petition filed by a student named Omkar. In the petition, the Graduate Medical Education Regulation 1997 was challenged, in which a provision has been made to bar candidates with 40 percent or more disability from admission in MBBS.
