‘Be it a temple or a dargah… religious construction will have to be removed from the middle of the road’, SC’s strict comment on bulldozer action

New Delhi: The Supreme Court said on Tuesday that public safety is most important. If any religious structure, be it a temple, dargah or gurudwara, encroaches on a road, water or railway line, it should be removed. The Supreme Court stressed that India is a secular country. Bulldozer action and anti-encroachment operations will be applicable to all citizens, irrespective of their religion. A bench of Justice BR Gavai and Justice KV Vishwanathan was hearing petitions challenging the action of bulldozers against people accused in crime cases. This action has been named ‘Bulldozer Justice’.

Supreme Court reserved the decision

The Supreme Court on Tuesday said it will issue guidelines to all citizens on the issue of demolition of properties. Along with this, the court reserved its decision on those petitions in which it has been alleged that the properties of the accused are being demolished in many states. The court said that its guidelines will be applicable across India. It is making it clear that merely being accused or guilty of a person cannot be a ground for demolition of property.

No separate law for any particular religion: Supreme Court

The bench of Justice BR Gavai and Justice KV Vishwanathan said that whatever we are deciding. Issuing it for all citizens, all institutions and not for any particular community. There cannot be a separate law for any particular religion. he/she will not patronize any unauthorized construction on public roads, government lands or forests. The court said that we will try to ensure that our order does not help those who encroach on any public place.

‘Being accused or guilty is not a basis for demolishing property’

After hearing the matter, the bench said that the order is reserved. The court further said that the ban on bulldozer action will continue till the final decision is taken in this case. Earlier, the court had said that if there is even a single case of illegal demolition then it is against the values ​​of our Constitution. The court said it would make it clear that being accused of a crime cannot be a ground for demolishing property.

Interim stay on bulldozer action will continue: SC

The Supreme Court said that this can be done only in cases of violation of civil rules. The court has extended the interim stay on demolition carried out without permission. The Supreme Court on Tuesday reiterated its position on ‘bulldozer justice’ and said mere accusation or conviction of a heinous crime cannot be a ground to demolish property.
