Bail orders should be stayed only in rare cases, if this happens without thinking then it will be a tragedy: Supreme Court


New Delhi: The Supreme Court made an important comment on the stay on bail during the hearing of a case. The apex court said that the stay on the bail order should be imposed only in rare and exceptional cases. The court also said that if the right to personal liberty is violated while staying the bail order, then it would be disastrous. A bench of Justices Abhay S Oka and Augustine George Masih made this remark.

The Delhi High Court had stayed the bail of Parvinder Singh Khurana in a case. Not only this, this case remained pending for more than a year. The Supreme Court stayed the order of the High Court on June 7. The bench said that the courts should stay the bail order only in rare and exceptional cases, such as when someone is involved in terrorist cases. Apart from this, where the order has been disobeyed or the provisions of the law have been circumvented.

Serious steps like staying the bail order should be taken only in exceptional circumstances.
