After this decision of the High Court, teachers of private schools are going to fight

Delhi High Court said that private teachers have the right to get salary equal to that of government schools.

The Delhi High Court, while hearing a petition, said that teachers of unaided private schools are entitled to pay and other allowances at par with government teachers. The High Court gave this decision when a private school had filed a petition. In response to this petition, the Delhi High Court has given its verdict. In the petition, the private school challenged the directive to pay salaries to its teachers as per the 7th Central Pay Commission.

Referring to Section 10 of the Delhi School Education Act, the Delhi High Court said in its judgment that the scale of salary and allowances, medical facilities, pension, gratuity, provident fund and other benefits of a teacher of a recognized private school is the same as that of the employees of government schools. Should not be less than The Court also referred to a notification issued by the Directorate of Education, directing all recognized schools to implement the recommendations of the 7th Central Pay Commission. A bench of Justice Manmohan and Justice Mini Pushkarna said that unaided private schools cannot escape their statutory responsibility and they must pay teachers the same salary and benefits as government schools. The Court observed that teachers of unaided private schools are also entitled to pay and facilities at par with their government school counterparts, as provided in the Delhi School Education Act, 1973.

Court dismissed the appeal

The court dismissed the challenging appeal saying it lacked merit. Apart from this, the court has also directed the appellant school to give benefits and salary to the teachers as per the provisions of the 7th Central Pay Commission. In this decision, the teachers have also been directed to pay the arrears till January 1, 2016. Please inform that three teachers of the same school had taken refuge in the High Court after the school was not given the benefit of the 7th Central Pay Commission.
