How can you demolish someone’s house even if he/she is guilty? Why did the Supreme Court make a strong comment on bulldozer action?

New Delhi : The Supreme Court on Monday made a strong comment on the bulldozer action in different states of the country. The apex court heard the petitions related to this. During this, the court said that how can a person’s house be demolished just because he/she is an accused. The Supreme Court said that it proposes to set guidelines on this issue.

Will not protect unauthorized construction

A bench of Justices BR Gavai and KV Vishwanathan, while dealing with the petitions filed against the demolition action, said that even if a person is guilty, it cannot be done without following the procedure prescribed by law. However, the Supreme Court made it clear that it will not protect any unauthorized construction. The bench said that we propose to lay down some guidelines on an all-India basis, so that the concerns regarding the issues raised can be addressed.

The next hearing will be on September 17

Solicitor General Tushar Mehta confirmed that properties cannot be demolished for criminal association. The Solicitor General told the Supreme Court that no property of a person is demolished just because he/she is involved in or convicted of any criminal case. he/she said that this is done only by strictly following the rules and procedure laid down under municipal laws.

Two petitions from Rajasthan, MP

Two aggrieved homeowners from Rajasthan and Madhya Pradesh had approached the Supreme Court against the demolition of their houses in their respective states. Both sought an urgent hearing in the matter. In the Rajasthan case, a house was demolished due to alleged offences committed by the tenant’s son. In Madhya Pradesh, a bulldozer was used to demolish the ancestral house of a joint family.

These days the term ‘Bulldozer Justice’ is becoming very popular among the public. It means a type of instant justice system in which houses, shops or any premises belonging to persons accused of a crime are demolished. The bench fixed the next hearing of the case for September 17.
