This disabled person passed UPSC four times, still did not get service, know the whole matter


New Delhi: Fingers have once again been pointed at the Union Public Service Commission (UPSC). The uproar over the trainee IAS officer Pooja Khedkar case has not even subsided. Meanwhile, a strange case has come to light related to disabled candidate Kartik Kansal, who studied mechanical engineering from IIT Roorkee. Kartik Kansal, who is suffering from muscular dystrophy, passed the UPSC exam four times, despite this he/she has not yet been included in any government service. This case has come to light at a time when IAS trainee Pooja Khedkar has been accused of misusing the disabled quota. Kartik, who has been using a wheelchair since the age of 14, was selected for the post of scientist in ISRO through All India Central Recruitment.

Karthik cleared UPSC 4 times

Kartik Kansal was selected for four civil services. his/her rank was 813 in the year 2019. In 2021, his/her rank was 271, in 2022 his/her rank was 784 and in 2023 he/she got 829. he/she has cleared the civil services exam a total of four times. In 2021, when his/her rank was 271, he/she should have got IAS even without the Divyang quota, because those with ranks 272 and 273 got IAS that year. However, in 2021, muscular dystrophy was not included in the list of conditions included in the eligible functional classification for IAS.

Still why did not you get IAS rank

Muscular dystrophy was included in the list for Indian Revenue Service (Income Tax) Group ‘A’ and Indian Revenue Service (Customs and Excise). However, these were in Kartik Kansal’s second and third choices. In 2019, when Kartik Kansal got 813 rank, he/she could have easily been allotted a service as there were 15 vacancies for locomotor disability at that time. Only 14 were filled at that time. In 2021, there were seven vacancies in the locomotor disability category and only four were filled. his/her rank was first in this category.

What did the medical board say about Karthik

Regarding Kartik Kansal, the medical board at AIIMS certified that he/she has muscle weakness. Both his/her hands and legs are affected by muscular dystrophy. Surprisingly, for IAS, a person with both hands and legs affected is eligible but not a person with muscular dystrophy. The board noted that he/she can barely operate fingers and can move around in a motorized wheelchair. It was also certified that he/she can see, hear, speak, communicate, read and write. However, he/she cannot stand, walk, pull, push, lift anything, bend, kneel, jump or climb. Although his/her original disability certificate showed his/her level of disability to be 60 per cent, the AIIMS medical board considered it to be 90 per cent.

Retired IAS raised the issue of Karthik

Sanjeev Gupta, a retired IAS officer, took up Karthik’s case and tweeted in his/her support. he/she said that this is like strangulation of justice. Karthik, who never takes help from anyone except for help in going to the toilet, even gave the civil services exam without any writer. he/she wrote the paper himself. he/she met all the physical requirements for IAS and IRS jobs, yet he/she was not given any service.

When Kartik Kansal sought the reason for the rejection through the central portal for grievance redressal, he/she got the reply: ‘PwBD candidates are allotted service as per functional classification and physical requirements prescribed by various cadre controlling authorities. There were no matching services on your turn as per your rank.

Retired IAS Sanjeev Gupta said why should functional classification and physical requirements for the same nature of work differ from service to service? If cerebral palsy is allowed for IAS, why not muscular dystrophy? Thankfully, everything has been merged into one from 2024. Now there will be no such mistake. Even as per the new merged criteria, Kartik is eligible to get IAS and if any carry forward post is vacant from previous years then true justice will be done by giving him/her IAS rank. This will partially correct the injustice done to him/her till now.

What did Karthik say about the whole matter

Kartik Kansal said that by joining the civil services, I wanted to prove that people like me can also do it. But I cannot comment further on this issue as the matter is pending in the court. Kartik’s case related to this issue is pending in the Central Administrative Tribunal.
