Mutchal Divorce is a legal process in which both husband and wife agree that they want to end their marriage. Mutual divorce is valid under Section 13B of the Hindu Marriage Act, 1955 in the country. In this, both sides have to prove that they cannot live together now and their marriage is completely broken. Usually there is no need to blame any one side, but it is a peaceful and consent-based way to eliminate the relationship.
Mutual divorce between Dhanashree and Chahal:
In the case of Indian cricketer Yuzvendra Chahal and choreographer Dhanashree Verma, both of them had applied for divorce by mutual consent in the Bandra Family Court of Mumbai in February 2025. According to reports, there were many problems in their marriage, such as frequent quarrels and lack of mutual understanding, due to which they were living separately for 18 months. The court asked him/her for a counseling session, which lasted for about 45 minutes, but both clarified that they want divorce. After this, the judge, validating his/her consent, approved the divorce.
Mutual divorce process:
Combined application: Both sides file a joint petition in the court, in which they say that they can no longer live together and want divorce.
-Cooling-off period: Usually there is a 6-month cooling-off period, so that both get time to think. However, in the case of Chahal and Dhanashree, the Bombay High Court had forgiven the period, as both were already living separately for 18 months.
– Counseling: The court sometimes orders counseling to ensure that the decision has been taken carefully.
– Final hearing: After confirmation of consent, the court gives the decision of divorce. Chahal and Dhanashree’s divorce were finalized on 20 February 2025.
